Those enforcement actions address pharma&#8217;s own communications. They do not address what AI says about pharma&#8217;s products.<\/p>\n\n\n\n<p>State-level regulators are more active on the consumer AI question. California&#8217;s AB 489 prohibits AI tools from using words or phrases that imply they are licensed healthcare providers, and mandates disclaimers stating the tool is AI. Other states are considering similar measures. Meanwhile, federal agencies including the FDA, FTC, and OIG are releasing their own AI guidelines \u2014 creating a patchwork that pharma marketers must reconcile without clear hierarchy.<\/p>\n\n\n\n<p>The honest assessment is that regulatory guidance on how pharmaceutical brands should manage their representation in consumer AI has not been written. As of early 2026, there is no specific FDA guidance on pharmaceutical brand representation in consumer-facing AI chatbots. If a patient takes a drug based on AI-generated information that omitted safety warnings, and experiences an adverse event, the reporting and liability chain is unclear. Pharma companies have robust pharmacovigilance systems for adverse events reported through traditional channels. There is no analogous mechanism for correcting the misconception that 400,000 AI conversations implanted in patients last week.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The &#8216;AI Share of Voice&#8217; Framework Pharma Needs<\/strong><\/h2>\n\n\n\n<p>Measuring brand presence in AI is not the same as measuring brand presence in traditional media. If AI is misrepresenting your drug&#8217;s indication or dosing, the intervention requires working with AI companies directly through their accuracy correction mechanisms \u2014 a process that varies by platform and has no standardized pharma-industry workflow.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The DTC Advertising Question<\/strong><\/h2>\n\n\n\n<p>The U.S. pharmaceutical industry spent $8 billion on direct-to-consumer advertising in 2023 \u2014 $3.6 billion of that on television alone. It was up from $6.6 billion in 2020. That spending buys reach in a media environment that is contracting. Television viewership among the 18-49 demographic has been declining for years. But the organizational tendency to treat AI presence as an IT or digital team problem rather than a brand strategy problem means the resource discussion is not happening at the right level. The VP of marketing who owns the DTC budget is not yet accountable for the brand&#8217;s AI share of voice.
