That scenario is not hypothetical. It is the logical result of two simultaneous trends: the explosion of AI chatbot use for health queries, and the near-total absence of pharmaceutical industry monitoring of what those chatbots actually say about specific drugs.

By late 2024, ChatGPT reached 1.8 billion monthly visits, making it one of the top 10 most-visited sites on the planet, while Perplexity AI grew to over 100 million monthly visits by Q4 2024. Google shows AI Overviews for an estimated 84% of informational queries, and health queries rank among the most heavily affected categories. In today’s climate, safety signals, misinformation, and regulatory sentiment often emerge through public discourse first. Modern social intelligence and pharmacovigilance approaches need to be proactive and context-aware, providing brands with reassurance and strategic insights.


The Legal Landscape in 2025 and 2026

The legal exposure from AI-generated off-label drug mentions sits at the intersection of product liability, promotional compliance, and a new and largely untested regulatory category.

Traditional product liability doctrine assigns responsibility to manufacturers when their products cause harm.
